The objective of this study was to investigate spouses and cohabiting partners roles and differences under the Inheritance law. The study examined the order of intestate succession to determine who can inherit and in what situation. This study examined the legal rights of the spouse in the case of succession and after a review of the spouse’s status, the focus was on the rights of the cohabiting partner. Finally, the study examined ways in which the position of the cohabiting partner can be improved. Cohabiting partners who wish to know their rights and ways to prepare for the death of another cohabitant can benefit from this thesis. The thesis method used was legal dogmatics which examines valid law and its content. The thesis made use of; legislation, legal presentations, case law, and legal literature and domestic legislation was particularly reviewed. The thesis also used a legal comparative perspective to provide an international sense of the status of a spouse and cohabiting partner. The study and its results showed that the status of the spouse is significantly better than the status of a cohabiting partner. The spouse will inherit the deceased spouse’s estate if the deceased spouse didn’t have direct heirs. A cohabiting partner doesn’t inherit their spouse’s estate unless they haven’t made a will. If the cohabiting partners wish to secure each other's status, they need to make a will for each other. Giving a gift or designating a beneficiary order for life insurance compensation are ways that cohabiting partners could also consider....
